Spring Creek Phase 5 (5A and 5B)

This site can hold about 1,165–1,469 homes under the zoning maximum for qualifying affordable housing. The top of that range is set by the dwelling unit limit (ZR 23-52); qualifying senior housing is exempt from it and could hold up to about 1,653. The Fresh Creek Urban Renewal Plan, in effect until 2036, caps these sites at 560 homes (see What binds first). The City's LIFT tracker lists 560 homes across its 2 records for this site. That is well under the low estimate for current zoning on the lots shown here.

The tracker lists Phase 5 in two parts. City documents approve its nine buildings as one project and do not say which lots belong to each part, so the figures are for all nine lots, counted once.

  • Spring Creek Phase 5A: 360 homes, Post Public Approval None of the City documents checked names Phase 5A. City Planning's 2022 report gives nine buildings with 560 homes for the whole phase; the tracker's 360 here and 200 for Phase 5B add up to that. Six December 2025 building filings on these lots give 360 homes in their unit fields, but three of them (417 Egan Street, 1090 Ashford Street and 474 Egan Street) give 80 there while their job descriptions say "TO PROVIDE 40 AFFORDABLE DWELLING UNITS", so by the descriptions the six filings add up to 240.
  • Spring Creek Phase 5B (Mix): 200 homes, Post Public Approval None of the City documents checked names Phase 5B. City Planning's 2022 report gives Site 3e/f three buildings with 200 homes, within 560 for the whole phase; three July 2026 building filings on Site 3e/f propose 200.

What City documents say

Facts from City documents that bear on the figures below. Each is quoted in the sources, and each speaks as of its document's date.

  • Approved by the City Council in October 2022

On October 27, 2022 the City Council approved the Fourth Amended Fresh Creek Urban Renewal Plan and the City Planning Commission's decision (C 220406 HUK). The plan change allows nine four-story buildings with about 560 affordable homes on vacant City-owned land in Spring Creek.

  • Urban renewal plan caps height and homes on each site

The Fresh Creek Urban Renewal Plan, as amended in 2022, limits each Phase 5 site to four stories and sets a maximum home count per site: 200 on Site 3a/b, 40 on Site 3d, 200 on Site 3e/f, 40 on Site 6a and 80 on Site 7a.

  • Urban renewal plan in effect until July 26, 2036

The amended Fresh Creek Urban Renewal Plan (April 2022) states that it remains in effect until July 26, 2036.

  • Six building applications filed in December 2025

On December 10, 2025, new-building applications were filed with the Department of Buildings for six four-story residential buildings on these lots, with 360 homes in total in their unit fields (three of the job descriptions say 40 homes where the unit field says 80). Department of Buildings records in September 2026 show three of them approved (including 1209 Cleveland Street on Block 4448, Lot 1) and three still in plan review.

  • Part of Site 3a/b is planned as a garden for residents

HPD's 2022 application says Site 3a/b will include an open area along Gateway Drive for passive open space, such as a garden, for residents of the new buildings and earlier phases.

  • Recorded lot areas may understate the land

MapPLUTO records Block 4445, Lot 100 (417 Egan Street) at 34,497 sq ft, but its drawn outline measures about 61,391 sq ft. City Planning's 2022 report gives the five Phase 5 sites as about 107,000, 21,000, 91,000, 24,000 and 37,000 sq ft, about 280,000 in all; the nine lots' recorded areas add up to 256,344 sq ft and their drawn outlines to about 279,000. The figures use the recorded areas, so they may understate the land.

  • Three building applications filed in July 2026

On July 29, 2026, new-building applications were filed with the Department of Buildings for three four-story residential buildings on Site 3e/f (1 Gateway Drive, 435 Locke Street and 1050 Ashford Street), with 200 homes in total. Department of Buildings records in September 2026 show all three with objections, not yet approved.

Some figures are shown as a span because the Zoning Resolution sets different limits depending on a condition public data do not settle: whether the site is on a waterfront block, which depends on a case review under ZR 62-11, since a block is bounded by a paper street and a tax block reaches the water's edge.

What binds first

Urban renewal plan limits

The Fresh Creek Urban Renewal Plan, in effect until July 26, 2036, limits every Phase 5 site to four stories and caps its homes: 200 on Site 3a/b, 40 on Site 3d, 200 on Site 3e/f, 40 on Site 6a and 80 on Site 7a, 560 in all.

What gets in the way

Flags are flags, not verdicts. Each comes from a public layer, named in the sources.

  • Hazard

Stormwater flooding in an extreme storm (2080s)

DEP's Stormwater Flood Map (extreme stormwater flood with 2080 sea level rise) shows nuisance flooding (4 in to 1 ft) and deep and contiguous flooding (1 ft or more) on about 1% of the site (3,400 sq ft).

  • Caution

Floor area depends on a condition public data do not settle

The Zoning Resolution sets different limits depending on a condition that public data do not settle here, so some figures are shown as a span. The note under the floor area figures says which condition, and why.

  • Note

An optional building form allows a little more

Beyond 100 feet of a wide street in R6, ZR 23-22 allows standard residences 2.20 FAR. A building using the optional sky exposure plane rules (ZR 23-73) may reach up to 2.43 FAR, depending on how tall it is and how much open space it keeps, but that ratio then applies to all its homes, affordable ones included, so the affordable figure does not rise.

  • Note

Lot areas disagree lot by lot

In all, the outlines come to about 278,987 sq ft, within 9% of the recorded lot area of 256,344 sq ft that the figures use. Recorded and drawn areas of single lots disagree more (block 4445 lot 100: 34,497 sq ft recorded, about 61,391 sq ft drawn, 56,602 sq ft of it outside mapped street beds), so figures for part of the site are less reliable than the total.

What this doesn't account for

Public data and the zoning text answer the questions above. These need information that is not public, or a decision that belongs to the City.

  • Public land use review (ULURP). Selling or leasing City land, or approving a housing project on it, generally goes through ULURP (community board, borough president, City Planning Commission, City Council), and this estimate does not presume the outcome.
  • Disposition of City property (Charter 384 / UDAAP). Transferring the land needs Mayoral approval under Charter Sec. 384 and, for HPD projects, usually Urban Development Action Area designation and project approval under NY General Municipal Law Article 16.
  • Environmental review (CEQR/SEQRA). Any discretionary approval, disposition or City funding triggers CEQR/SEQRA review, which can require mitigation (e.g. for hazardous materials, noise or historic resources) or reshape the project.
  • (E) designations. A lot with an (E) designation or environmental restrictive declaration for hazardous materials, air quality or noise cannot receive building permits until the Office of Environmental Remediation signs off.
  • Subsurface and site conditions. Unknown soil, rock, groundwater and contamination can shrink or eliminate cellars and add foundation and cleanup costs, and HPD requires every project to investigate and, if needed, remediate contamination.
  • Deed restrictions and reverter clauses. Land the City bought or sold may carry deed restrictions or reverter clauses limiting its use, which must be checked in title records (ACRIS) and DCAS's deed-restriction database.
  • Parkland alienation. If a site is municipal parkland, it cannot be sold or used for housing without an act of the State Legislature signed by the Governor.
  • Current occupants, uses and agency plans. Many City-owned lots are in active use or assigned to an agency, or have funded capital projects, and this estimate does not reflect relocation needs or agency plans (check COLP and the Capital Commitment Plan).
  • Mapped streets, easements and utilities. Mapped-but-unbuilt ('paper') streets, sewer and water easements and utility lines can take land out of the buildable area, and no permit may be issued for a building in the bed of a mapped street.
  • Street access. A lot with no frontage on a mapped street cannot get a building permit on its own and must be combined with a neighboring lot or have access mapped.
  • Landmarks review. Sites that are individual landmarks or inside historic districts need Landmarks Preservation Commission approval, which can limit demolition, height and bulk.
  • Flood-resistant construction. Sites in the 1% annual chance floodplain (or the 0.2% shaded X-Zone for critical facilities) must meet Building Code Appendix G, whose elevation and floodproofing rules can cost usable ground-floor and cellar space.
  • Airport height limits. Near JFK, LaGuardia and Floyd Bennett Field, zoning flight-obstruction surfaces cap building height, and tall structures anywhere need FAA notice.
  • State and federal funding conditions. Federal or State money brings its own requirements (e.g. HUD environmental review under 24 CFR Part 58, Davis-Bacon prevailing wages, Section 3 hiring) that can change cost, timing and program.
  • Zoning capacity is a ceiling, not a plan. The figures show what zoning allows, and actual HPD projects often build less, for example to fit neighborhood context, a community facility or funding limits.
